Sparked by global capitalism’s demand for new knowledge and new commodities, as well as new logistical systems to deliver them, the nature of education has changed significantly. Universities, in striving to become a part of this knowledge society, have focused on responding to these demands, at the expense of the humanities and social sciences. The dominance of this way of thinking, primarily a product of Western educational thought, has clearly affected approaches to education in the East. The originalities, authenticities, and (...) unique perspectives of the East have failed to get enough attention, subsumed by the focus on science and technology. However many education systems are still endeavouring to capture some of the indigenous and authentic culture of their home countries, incorporating national cultural ideals, even in subjects with a primarily vocational focus. Although the drive for scientific knowledge has led to a degree of standardisation and convergence, cultural differences still play a role in the education theory and policy of different countries. This book examines these cultural differences between different East Asian and South Asian countries, with chapters ranging from historical educational analysis to contemporary re-interpretations of the construction of society and education in the East. This longitudinal study examined how nursing students' moral judgment changes after they become qualified nurses working in a hospital environment. The sample used was a group of 80 nursing students attending a university in Suwon, Korea, between 2001 and 2003. By using a Korean version of the Judgment About Nursing Decisions questionnaire, an instrument used in nursing care research, moral judgment scores based on Ketefian's six nursing dilemmas were determined. The results were as follows: (1) the qualified nurses had significantly (...) higher idealistic moral judgment scores than the nursing students; (2) the qualified nurses showed significantly higher realistic moral judgment scores than the nursing students; and (3) when comparing idealistic and realistic moral judgment scores, both the qualified nurses and the nursing students had higher scores for idealistic moral judgment. Further study is recommended to examine changes in moral judgment. (shrink)

This study analyses the types and frequencies of ethical dilemmas and the rationale of ethical decision making in student nurses; it also evaluates their decision making. One hundred senior student nurses who were enrolled in a two-credit course in nursing ethics were asked to provide an informal description of a dilemma that they had experienced during their clinical practice. The results were as follows. The ethical dilemmas identified fell into four categories and were of 27 types. Those most frequently experienced (...) were ‘family giving up on a patient because he or she could not be cured’, and ‘not telling the truth to the patient’. The Korean Nurses’ Code of Ethics was applied, in particular the preamble, and the third, fourth, seventh and tenth clauses. The most common rule of ethics and principle applied in these nurses’ ethical decision making were veracity and nonmaleficence. With regard to the moral reasoning process, the primary concern was the welfare of the patients. These students were equipped with the ability to exercise critical and reflective thought when they experienced ethical dilemmas. (shrink)

This article aims at an active dialogue between Ulrich Beck and East Asia with respect to cosmopolitan imagination. Beck’s cosmopolitan sociology requires a reflective cosmopolitan publicness to cope with various kinds of global risks. We therefore extract three different layers of publicness from neo-Confucianism – survival-oriented, deliberative, and ecological – and argue that Beck’s cosmopolitan vision can be better conceptualized when properly linked to, or founded upon, the Tianxiaweigong normative potentials of neo-Confucianism. In so doing our intention is to make (...) Beck’s implicit sensibilities and the implicit Asian orientations explicit, as a double process of cosmopolitan self-reflection and dialogue. We also draw attention to the analysis of the cosmopolitan actor in East Asia. Finally, we note that the cosmopolitan future of East Asia still remains uncertain and that reconciling global risk politics, national interests and cosmopolitan morality presents a big challenge to second modern transformation. 본고의 논의는 신경이미지 실험이 윤리학적 논의에 어떻게 연관될 수 있으며 어떤 영향들을 미칠 수 있는가를 보여주는 사례를 다룬다. 본고의 목표는 그린(J. Greene)의 이중과정 모델(Dual Process Model)을 뒷받침하는 신경이미지 실험에 대한 비판적 고찰을 통해 그린의 입장이 가지고 있는 문제점을 제시하는 것이다. 이 목표를 이루기 위해 우선 그린의 이중과정 모델을 지지하는 신경이미지 실험에 대해 설명할 것이다. 본고에서 다루는 신경 실험은 인간이 도덕적 판단을 할 때 어떤 경우에는 인지적 판단을 하고 어떤 경우에는 감정적 판단을 한다는 것을 보여준다. 그린의 주장에 따르면, 인지적 판단은 공리주의적 (...) 판단이고 감정적 판단은 의무론적 판단이다. 감정적 판단은 집단 내의 도덕적 문제를 해결하는 데에는 유용할 수 있지만 상식을 공유하지 않는 집단들 사이에서 일어나는 도덕적 갈등을 해결하는 데에는 도움이 되지 못한다. 이런 문제들을 해결하기 위해선 인지적 판단을 기반으로 한 도덕 이론을 가져야 한다고 그린은 주장한다. 논자는 그린의 주장이 가진 몇 가지 문제점을 제시할 것이다. 우선, 감정적 판단이 집단과 집단 사이의 도덕적 갈등을 해결하는데 적절하지 않으며 이런 종류의 문제를 해결하기 위해서는 공리주의적 사고를 추구해야 한다는 그린의 주장에 반대할 것이다. 집단 사이의 문제를 해결하기 위해 공리주의적 사고를 적용할 때 나타날 수 있는 문제점을 제시할 것이다. 또한 감정에 기반을 둔 판단에 의존하는 것이 때로는 이런 도덕적 문제를 해결하는 데 도움이 될 수 있다고 주장할 것이다. 다음으로, 그린의 신경이미지 실험에서의 감정적 판단이 의무론적 판단이라는 입장에 문제가 있다고 주장할 것이다. 이어서 그린이 말하는 감정적 판단이 의무론적 판단이 아닌 다른 종류의 판단일 수 있다는 것을 주장할 것이다. 그러한 판단은 유덕한 사람이 내리는 판단 혹은 의지적 필연성(volitional necessity)에 의해 내려진 판단일 수 있다고 주장할 것이다. 마지막으로 그 판단은 자기충실성을 가진 사람이 내리는 판단일 수 있다고 주장할 것이다. This Korean study replicated a previously published American study. The conceptual framework and method combined ethical enquiry and phenomenology. The research questions were: (1) What is nursing students’ experience of ethical problems involving nursing practice? and, (2) What is nursing students’ experience of using an ethical decision-making model? The participants were 97 senior baccalaureate nursing students, each of whom described one ethical problem and chose to use one of five ethical decision-making models. From 97 ethical problems, five content categories emerged, (...) the largest being health professionals (69%). The basic nature of the ethical problems was the students’ experience of conflict, resolution and rationale. Using an ethical decision-making model helped 94% of the students. A comparison of the Korean and American results yields important implications for nursing ethics education, practice and research. (shrink)

BackgroundThis study aimed to identify the healthcare providers’ experience and perspectives toward end-of-life care decisions focusing on end-of-life discussion and physician’s order of life-sustaining treatment documentation in Korea which are major parts of the Life-Sustaining Treatment Act.MethodsA cross-sectional survey was conducted using a questionnaire developed by the authors. A total of 474 subjects—94 attending physicians, 87 resident physicians, and 293 nurses—participated in the survey, and the data analysis was performed in terms of frequency, percentage, mean and standard deviation using the (...) SPSS 24.0 program.ResultsStudy results showed that respondents were aware of terminal illness and physician’s order of life-sustaining treatment in Korea well enough except for some details. Physicians reported uncertainty in terminal state diagnosis and disease trajectory as the most challenging. Study participants regarded factors (related to relationships and communications) on the healthcare providers’ side as the major impediment to end-of-life discussion. Study respondents suggested that simplification of the process and more staff are required to facilitate end-of-life discussion and documentation.ConclusionBased on the study results, adequate education and training for better end-of-life discussion are required for future practice. Also, a simple and clear procedure for completing a physician’s order of life-sustaining treatment in Korea should be prepared and legal and ethical advice would be required. Since the enactment of the Life-Sustaining Treatment Act, several revisions already have been made including disease categories, thus continuous education to update and support clinicians is also called for. Émile Durkheim remains one of the most controversial, and deeply misunderstood, classics of social theory. His work differs from the dominant version of sociology that has essentially accepted the modernist self-description of contemporary societies; and it contradicts the individualism that has come to dominate the social sciences. For everybody who is interested in constructing theoretical alternatives to this individualism, Durkheim's sociology can be a useful inspiration - not only because of the solutions it suggests, but already because of the questions (...) it asks. Making use of the theoretical possibilities offered by the Durkheimian tradition, however, requires going beyond the familiar appropriations. The Oxford Handbook of Émile Durkheim takes stock of the different recent debates on Durkheimian sociology, and makes them accessible to a wide audience spanning various disciplines; this includes crucial debates that, due to language barriers, are not easily accessible for an English-reading public. Dutch euthanasia legislation states that an act of euthanasia is only permissible if it is based on a voluntary request made in a situation of unbearable suffering to which there are no alternatives.The central question of this article is whether these criteria can be satisfied simultaneously. In an analysis of several (partly overlapping) definitions of voluntariness it is argued that there are circumstances in which this question should be answered negatively.The possible incompatibility of the criteria reveals a tension between different (...) defences of the permissibility of euthanasia. Enlightened experience (i.e. awakened to the truth) is the most valuable one in most religions including Christianity and Buddhism. As well-known cases of such experience are Apocalypse St. Paul and many Grand Zen masters in Zen Buddhism, it is natural for us to believe that the enlighten is for very talented or speciallytrained ones. However, applying the complexity theory on the structure of enlightenment, based on the power law function, selforganized criticality, phase transition, and emergence, it is clear that the (...) full awakening can be experienced by everyone in daily life. Furthermore, such experiences are not necessary to be limited in religious one. Rediscovering the path to full awakening by complexity theory leads to the demythologization of the enlightenment in Korean Zen Buddhism, which emphasizes a hard apprenticeship in temple for long periods for the purpose. In 'Yeogi (禮記)', the Chinese scriptures of Confucianism, they recoded the solar calendar of modern viewpoints. According to the ancient document, the 24 solar terms was one of seasonal divisions in a year. The regularly change of the four seasons play an important part in the national economic project. For a national economy depended on agriculture in East Asia of ancient times, the administration to pay no regard to the change of the season was directly connected to the fall of (...) the nation. And then the legislator must enact laws to reflect the change of the season. According to the 'Wolryeong (月令)' in 'Yeogi (禮記)', there is recoded national regulations to suit with the each twelve momth. The first month of spring is the prime of the year (February). The month shows sign of new livingthings. The ruler take order to protect the first breath of spring and ought to put a ban on the military training and labor mobilization. The reasons are to safeguard the new life and not to interrupt the preparation for farming. Confucian attach value to the nature within a human’s way of life. Therefore the norm of human do correlate closely with the principle of nature. The rule of Wuju (宇宙) was not a simple concept of the natural phenomenon and Cheon (天) was not the Almighty for himself. Cheon was just the existence of virtue and moral influence in the confidence of man. And Ji (地) was the Mother of all things. In this space man had to manage the world in sympathy with the process of cheonJi (天地); Cheonsi (天時), JIri (地利), Inhwa (人和). (shrink)

This paper presents a non-preference-based approach to the analysis of negative freedom. It is argued that a proper understanding of (different conceptions of) negative freedom necessitates an examination of the consequences of changes in the set of feasible alternatives. For this reason the paper does not focus on freedom rankings of opportunity sets but on freedom rankings of opportunity situations, i.e., pairs consisting of a feasible set and an opportunity set. Three different freedom rankings of opportunity situations are axiomatically characterised. (...) This article analyses the relationship between rights and capabilities in order to get a better grasp of the kind of consequentialism that the capability theory represents. Capability rights have been defined as rights that have a capability as their object (rights to capabilities). Such a definition leaves the relationship between capabilities and rights to a great extent underspecified since nothing is said about the nature of those rights. Hence, it is not precluded that they are mere negative liberties, something that (...) capability theorists deny. On the other hand, to say that all capability rights are substantive in the sense that they themselves are capabilities (rights as capabilities) will in a significant number of cases fail to match well with our intuitions. This article presents an account of the relationship between rights and capabilities that avoids these problems of underspecification and of plausibility, respectively. First, it is argued that to take the idea of capability rights seriously, three new ‘list issues’ need to be addressed. Second, developing a point made by Nussbaum, it is argued that capability rights are to be defined as being purely instrumental. Whereas the resulting analysis of capability rights solves the problems of underspecification and plausibility, it raises doubts about the claim that the capability approach gives more importance to rights than do traditional forms of consequentialism. Recent theories of negative freedom see it as a value-neutral concept; the definition of freedom should not be in terms of specific moral values. Specifically, preferences or desires do not enter into the definition of freedom. If preferences should so enter then Berlin's problem that a person may enhance their freedom by changing their preferences emerges. This paper demonstrates that such a preference-free conception brings its own counter-intuitive problems. It concludes that these problems might be avoided if the description of (...) the constraints which specify an agent's lack of freedom include the intentions of those who constrain the agents. This paper makes a contribution to the further development of the game-theoretic analysis of rights. The model presented here differs in several respects from the existing models. First of all, a distinction is made between outcome-oriented and action-oriented rights, a distinction which is closely related to the distinction between active and passive rights. Second, the legal-theoretic notions of negative and positive rights are formally defined. Third, we not only discuss the definition of rights, but also the way rights can be (...) violated. Using the distinction between negative and positive rights on the one hand, and between active and passive rights on the other, four different types of basic rights are distinguished. For each of these rights, the situations in which they can be said to be respected are examined. We thereby distinguish two possible sources of obstruction: by (groups of) individuals, and by law. Finally, the question of the possible realization of rights is examined. Depending on how the problem of the possible mutual incompatibility of rights is addressed, two distinct approaches are examined. It turns out that in both approaches the possible realization of rights crucially depends on characteristics of the 'state of nature'. (shrink)

A hard choice is a situation in which an agent is unable to make a justifiable choice from a given menu of alternatives. Our objective is to present a systematic treatment of the axiomatic structure of such situations. To do so, we draw on and contribute to the study of choice functions that can be indecisive, i.e., that may fail to select a non-empty set for some menus. In this more general framework, we present new characterizations of two well-known choice (...) rules, the maximally dominant choice rule and the top-cycle choice rule. Together with existing results, this yields an understanding of the circumstances in which hard choices arise. (shrink)

In this article we pose three questions: 1) What are the questions that gave rise to the introduction of the concept and subdiscipline of meta-ethics? 2) What characterises the view of meta-ethics as a subdiscipline of moral philosophy? And 3) is it in fact possible to uphold a systematic distinction between normative moral philosophy and meta-ethics in a way that allows us to see these two aspects of moral philosophy as independent subdisciplines? In trying to answer these questions, we trace (...) two different roads in the shaping of the current understanding of meta-ethics: the introduction of the word in analytical moral philosophy and the characterisation of meta-ethics in the formative period of meta-ethics and in contemporary introductions. Among the characteristics ascribed to meta-ethics, we identify a special focus on normative neutrality, and we furthermore show that this idea of neutrality as the defining characteristic of meta-ethics cannot be upheld. Our aim is to show that meta-ethics cannot be characterised or construed in a way that is normatively neutral and independent of other work done in normative ethics. We therefore challenge the claim that meta-ethics makes up a subdiscipline that is independent of other work done in moral philosophy. Instead, we suggest a reflective view of the relationship between meta-ethics and normative ethics, according to which we should acknowledge that meta-ethics is inherently normative, and that meta-ethical questions are interwoven with normative questions in moral philosophy.
